1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and WorkersLab LLC ("we," "us," or "our") concerning your access to and use of Formigo (the "Service").

By accessing or using Formigo, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Formigo is a form submission management service that allows users to:

• Create and manage forms programmatically via API
• Receive form submissions from their websites or applications
• Configure notification channels (email, webhooks, Slack, Discord, Google Sheets)
• Implement spam protection measures
• Store and retrieve form submission data

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, though we will make reasonable efforts to notify users of significant changes.

3. Account Registration and Security

3.1 Account Creation

To use Formigo, you must:

• Provide a valid email address
• Create a secure password
• Confirm your email address
• Be at least 13 years of age (or the age of majority in your jurisdiction)

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Restrictions

You may not:

• Create multiple accounts to circumvent service limitations
• Share your account with others
• Transfer your account without our written consent
• Use another user's account without permission

4. Acceptable Use Policy

4.1 Permitted Use

You may use Formigo to:

• Collect legitimate form submissions from your websites or applications
• Store and manage form data for lawful business purposes
• Configure integrations with third-party services you control

4.2 Prohibited Use

You may not use Formigo to:

• Collect illegal data - Gather information for illegal purposes or in violation of laws
• Send spam - Generate, distribute, or facilitate spam, unsolicited emails, or mass marketing
• Phishing - Create forms designed to deceive users or steal credentials
• Malware distribution - Host, distribute, or facilitate malware, viruses, or harmful code
• Harassment - Harass, threaten, or abuse other users or individuals
• Privacy violations - Collect personal data without proper consent or disclosure
• Unauthorized access - Attempt to access systems or data you don't have permission to access
• Service abuse - Overload, attack, or attempt to disrupt the Service
• Circumvent limitations - Bypass rate limits, security measures, or usage restrictions
• Resale - Resell or redistribute the Service without authorization

Important: Violation of this Acceptable Use Policy may result in immediate account suspension or termination without notice or refund.

4.3 Data Collection Compliance

When collecting data through Formigo, you must:

• Comply with all applicable privacy laws (GDPR, CCPA, etc.)
• Provide clear privacy disclosures to your users
• Obtain necessary consents for data collection
• Not collect sensitive data (health, financial, biometric) without proper safeguards
• Implement appropriate security measures for collected data

5. Pricing and Payment

5.1 Free Service

Formigo is currently offered as a free service at no cost to users. We reserve the right to:

• Introduce paid plans or premium features in the future
• Implement usage limits or quotas
• Change pricing structures with reasonable notice

Any future pricing changes will not affect existing users without at least 30 days' notice and will not apply retroactively to data or usage under the free tier.

5.2 Service Limitations

While the service is free, we may implement reasonable limitations including:

• Form submission rate limits
• Storage capacity limits
• API request rate limits
• Number of forms or notification channels

6. Intellectual Property Rights

6.1 Service Ownership

Formigo, including all code, design, branding, and functionality, is owned by WorkersLab LLC and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble the Service
• Remove or modify any copyright or trademark notices
• Use our branding without written permission

6.2 User Data Ownership

You retain all ownership rights to the data you submit to Formigo, including:

• Form configurations and settings
• Form submission data
• Notification channel configurations

By using the Service, you grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Service to you.

6.3 API and Integration Use

You may integrate Formigo into your applications and websites, provided you:

• Comply with our API documentation and best practices
• Do not misrepresent your relationship with Formigo
• Credit Formigo appropriately if required by your use case

7. Service Availability and Support

7.1 Uptime and Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Emergency maintenance or security updates
• Technical difficulties or server issues
• Third-party service dependencies

7.2 Support

We provide support via email at [email protected]. Support is provided on a reasonable-effort basis with no guaranteed response times.

7.3 Beta Features

We may offer beta or experimental features. These features are provided "as is" and may be:

• Unstable or incomplete
• Changed or removed without notice
• Not suitable for production use

8. Data Privacy and Security

Our data handling practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We implement industry-standard security measures
• We do not sell or share your data with third parties except as disclosed
• You can export or delete your data at any time
• We comply with GDPR, CCPA, and other applicable privacy laws

However, no internet service is 100% secure. You use Formigo at your own risk and are responsible for implementing appropriate security measures in your own applications.

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting us at [email protected]. Upon termination:

• Your access to the Service will be immediately revoked
• Your data will be retained for 30 days for recovery purposes
• After 30 days, all data will be permanently deleted

9.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms or our Acceptable Use Policy
• Your account is inactive for an extended period (we will provide notice first)
• We are required to do so by law
• We discontinue the Service

For violations of the Acceptable Use Policy, we may terminate immediately without notice. For other reasons, we will provide reasonable notice when possible.

9.3 Effects of Termination

Upon termination:

• You must immediately cease using the Service
• You remain responsible for any violations that occurred before termination
• Sections of these Terms that should reasonably survive termination will continue to apply

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of data
• Warranties that defects will be corrected

You acknowledge that:

• Your use of the Service is at your sole risk
• You are responsible for implementing your own data backups
• We do not warrant that the Service meets your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKERSLAB LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Unauthorized access to or alteration of your data
• Actions or content of third parties
• Any matter beyond our reasonable control

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless WorkersLab LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of third-party rights, including privacy or intellectual property rights
• Data you collect through the Service
• Your interactions with other users or third parties

13. Third-Party Services

Formigo integrates with third-party services (Google Sheets, Slack, Discord, etc.). Your use of these integrations is subject to:

• The third party's terms of service and privacy policies
• Your own agreements with those third parties
• Availability and changes made by those third parties

We are not responsible for:

• The actions, policies, or practices of third-party services
• Changes or discontinuation of third-party services
• Data shared with third-party services through integrations you configure

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing any legal action, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We commit to working with you in good faith to reach a resolution.

14.3 Arbitration

If we cannot resolve a dispute informally within 60 days, any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Wyoming, and the arbitrator's decision will be final and binding.

14.4 Class Action Waiver

You agree that disputes will be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14.5 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to systems.

15. General Provisions

15.1 Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

15.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WorkersLab LLC regarding the Service and supersede all prior agreements.

15.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.4 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

15.5 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

15.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service provider failures.

15.7 Export Control

You agree to comply with all applicable export and import laws and regulations. You may not use the Service if you are located in a country subject to U.S. embargo or other restrictions.
